By accessing or using BeamTo, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our App.
2. Description of Service
BeamTo is an AI-powered mobile application that allows users to:
- Type a text prompt describing any place, real or imagined
- Generate AI-created 360° panoramic worlds from that prompt
- Look around generated scenes by dragging or moving their device
- Save and revisit their favorite generated worlds
The service uses artificial intelligence and machine learning technology to generate images according to user instructions.
3. User Eligibility
BeamTo is designed for users ages 4 and up, consistent with our App Store content rating. For users under 13, parental supervision and consent is required. If you are under 18, you must have parental or guardian consent to use the App. Users under 18 should review these Terms with their parent or guardian.
4. User Content and Rights
Your Prompts: You are responsible for the text prompts you submit to BeamTo ("User Content").
License to Process: By submitting a prompt, you grant BeamTo a limited, non-exclusive license to process your prompt solely for the purpose of generating the AI 360° world you requested.
Content Responsibility: You are solely responsible for your prompts and the content you generate, and you must ensure your use complies with these Terms and all applicable laws.
5. Prohibited Uses
You agree NOT to use BeamTo for:
- Generating inappropriate, offensive, or harmful content
- Generating content for illegal or unethical purposes
- Attempting to reverse engineer or copy our AI technology
- Violating any applicable laws or regulations
- Creating content that infringes on intellectual property rights
- Generating content depicting minors in inappropriate contexts
- Any use that would be inappropriate for the 4+ age rating
For Users Under 13: Parental supervision is required. Parents should review all content created and ensure appropriate use of the application.
6. AI Technology and Accuracy
Important: BeamTo uses AI technology that may not always produce perfect or expected results. Generated worlds are created by artificial intelligence and should be understood as artistic interpretations, not exact or accurate representations of real places.
We make no guarantees about the accuracy, quality, or suitability of AI-generated content. Results may vary and are influenced by your prompt and other factors.
7. Privacy and Data Processing
Your privacy is important to us. Please review our Privacy Policy to understand how we handle your prompts and data when you use BeamTo. Your prompts are transmitted to OpenAI solely to generate your requested results. By using the App, you also consent to our data practices as described in the Privacy Policy.
8. Intellectual Property
BeamTo, including its AI integration, design, and content, is protected by intellectual property laws. You may not copy, modify, or redistribute any part of our technology or service without written permission.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- BeamTo is provided "AS IS" without warranties of any kind
- We are not liable for any damages arising from your use of the App
- Our total liability shall not exceed the amount you paid for the App (if any)
- We are not responsible for how you use or share AI-generated content
10. Indemnification
You agree to indemnify and hold BeamTo harmless from any claims, damages, or expenses arising from your use of the App, violation of these Terms, or infringement of any rights of another party.
11. Termination
We may terminate or suspend your access to BeamTo at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the App at any time.
12. Updates and Changes
We may update these Terms from time to time. We will notify users of significant changes through the App or our website. Continued use of BeamTo after changes constitutes acceptance of the new Terms.
13. App Store Terms
If you download BeamTo through the Apple App Store, you acknowledge that these Terms are between you and BeamTo, not Apple. Apple is not responsible for the App or any claims related to it.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, United States. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
16. Subscriptions and Payments
If you purchase a subscription, your payment will be processed through the App Store. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You may manage or cancel your subscription in your App Store account settings.
17. Content Moderation
We reserve the right to restrict generation of content that violates these Terms, and to report violations to appropriate authorities if necessary. See our Privacy Policy for details on how your prompts are processed.
